1) About Shop Rides

Newman Performance Shop Rides (“Ride”) are social group motorcycle rides that start and finish at 1/36 Lawrence Drive, Nerang QLD.

They are not a guided tour, training session, or supervised ride.

2) Who can participate

By attending/participating you confirm that: 

• You are of legal riding age and hold a current valid motorcycle licence appropriate for the motorcycle you are riding (including complying with any conditions/restrictions such as LAMS).
•  Your motorcycle is road-registered and legal for use on Queensland roads.
•  You are fit to ride and not impaired by alcohol, drugs, fatigue, illness, or any condition that could affect safe riding.

3) Your responsibilities

You agree that you are solely responsible for: 

• Ensuring your motorcycle is roadworthy, properly maintained and safe. 
• Wearing appropriate protective gear, including an approved motorcycle helmet and any other safety gear you choose to wear. 
• Riding within your ability and making your own decisions about speed, following distance, overtaking, lane position and whether to continue at any time. 
• Following all road rules and laws. 
• Your own fuel, tolls, food/drink, and breakdown/towing arrangements.

4) Safety & behaviour

For everyone’s safety:

• No racing, stunts, burnouts, hooning, aggressive riding, or unsafe behaviour.
•  No alcohol or drugs before or during the Ride.

Newman Performance may refuse participation or ask a participant to leave if we reasonably believe the participant’s behaviour or motorcycle creates a safety risk.

5) Risk warning

• You acknowledge that motorcycle riding is inherently risky and may result in serious injury, death, or property damage.
• Risks may include (without limitation) traffic, rider error, other road users, road surface changes, weather, wildlife, debris, and mechanical failure.

6) Accidents, injury, and damage — liability disclaimer

Participation is voluntary and at your own risk.

To the extent permitted by law, you agree that Newman Performance, Richard Newman, and any associated staff/contractors are not responsible or liable for any loss, damage, cost, injury, death, or claim arising from or in connection with your participation in the Ride, including (without limitation):

• any accident, collision, fall, or incident involving you or your motorcycle,
•  damage to or loss of your motorcycle, helmet, gear, accessories or any other property (including theft),  
• injury or death to you, a passenger, or any other person,
• any costs you incur (repairs, towing, medical costs, loss of income, etc.),
• except where liability cannot legally be excluded.

7) Release & indemnity

To the extent permitted by law, you:

• release Newman Performance / Richard Newman / staff/contractors from claims you may have arising from your participation, and
• agree to indemnify Newman Performance / Richard Newman / staff/contractors against claims made by other people arising from your acts/omissions during the Ride (for example, if your riding causes injury or damage to someone else).

8) Australian Consumer Law notice (important)

• Australian Consumer Law may provide certain guarantees that cannot be excluded in some circumstances.
• Where permitted, Newman Performance relies on applicable provisions relating to recreational services.

9) Photos & video (media consent)

Newman Performance (or someone we engage) may take photos and video at the shop and during the Ride for promotional and community purposes (including website and social media).

By attending, you consent to being photographed/filmed and to the use of that content by Newman Performance.

Opt-out: If you do not want to be photographed/filmed, please notify staff on arrival and we will take reasonable steps to avoid capturing you or to remove/blur you where practical.

10) Passengers

Passenger riders must also be of legal age, wear an approved helmet and appropriate gear, and are covered by these terms. 

11) Acceptance

By attending and participating in a Newman Performance Shop Ride, you confirm you have read, understood and agree to these terms.
